OVERVIEW

Welcome to Outdoor Furniture Warehouse Pty Ltd (ABN 886 262 018 67) (”OFW”, “we”, “us” or “our”). We operate the website outdoorfurniturewarehouse.com.au (the “Site”) and supply all products, content, features, tools and services described on the Site (collectively, the “Services”). The Site is hosted and our checkout is powered by Shopify; however, all sales are made directly with OFW.

By accessing or using any part of the Services you agree to be bound by these Terms of Service (”Terms”) and by our Privacy Policy and Returns Policy (together, the “Policies”). If you do not accept the Terms or Policies, you must not use the Services.

1. USING THE SERVICES

You must be at least 18 years old (or the age of majority where you live) to place an order. If you are under 18, you must have a parent or guardian’s consent.
You agree to provide accurate, current and complete information at checkout or when opening an account.
You are responsible for any activity that occurs under your login details. Keep them secure and notify us immediately of unauthorised use.

2. OUR PRODUCTS

We sell only in-stock items. Product photos and colours are provided in good faith but may look different on your device. Minor variations (e.g. natural grain or shade) are not defects.

We may change, limit or discontinue products at any time without notice.

3. PRICING & PAYMENT

All prices are listed in Australian dollars (AUD) and include GST unless stated otherwise.
Prices apply at the time you place your order and may differ from prices offered elsewhere.
We accept Shopify Payments (Visa, Mastercard, Amex), Afterpay and Zip. By submitting a payment you warrant that you are authorised to use the nominated method and that funds are available.

Promotions may have their own terms. If those conflict with these Terms, the promotion terms prevail for that offer.

4. ORDERS

Your order is an offer to buy. We will email an order-confirmation when payment is authorised; at that point a contract is formed. We may refuse or cancel an order (for example, due to error, suspected fraud or stock issues) and will refund you in full if we do.

Purchases are for personal or household use only and must not be resold without our prior written consent.

5. SHIPPING, DELIVERY & PICK-UP

Local delivery	As soon as next business day	We text you the afternoon before with a 2–3 hr window, and drivers text again when en-route. Delivery is to your backyard only – no assembly and no signature required.

Risk of loss passes to you once goods are delivered to the delivery address or collected, subject to your non-excludable rights under the Australian Consumer Law (ACL).

Delivery dates are estimates; we are not liable for delays caused by factors outside our reasonable control (e.g. traffic, extreme weather).

6. RETURNS & CHANGE-OF-MIND

You may return unused, resale-condition items within 14 days of delivery or pick-up in line with our Returns Policy (freight at your cost unless the product is faulty). This is in addition to your rights under the ACL – see Section 7.

7. AUSTRALIAN CONSUMER LAW GUARANTEES

Our goods come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure is not a major failure.

Nothing in these Terms limits or excludes any rights you have under the ACL or other applicable legislation.

8. VOLUNTARY WARRANTIES

Where stated on a product page, we provide the following additional warranties:

Frames: 3 years from delivery or pick-up.
Fabrics: 2 years from delivery or pick-up.

These warranties run concurrently with, and not in place of, your ACL rights. They cover manufacturing defects only and do not cover normal wear, misuse, neglect, or commercial use.

To claim, email team@outdoorfurniturewarehouse.com.au with proof of purchase, photos and a description of the issue.

9. INTELLECTUAL PROPERTY

Unless stated otherwise, all content on the Services is owned by OFW or its licensors and is protected by Australian and international IP laws. You may view the Site for personal use but must not reproduce or exploit any content without written permission.

10. OPTIONAL TOOLS & THIRD-PARTY LINKS

We may provide access to third-party apps (e.g. finance gateways) or link to external sites. Use them at your own risk; we do not control or endorse them and are not responsible for their content or conduct.

11. FEEDBACK

If you submit reviews, ideas or other content (“Feedback”), you grant us a perpetual, irrevocable, royalty-free licence to use it for any purpose. You warrant that your Feedback is accurate and lawful.

12. PROHIBITED USES

You must not misuse the Services (e.g., transmit malware, infringe IP, harass others, scrape data, or engage in any unlawful activity).

13. TERMINATION

We may suspend or terminate your access if we reasonably believe you have breached these Terms. Sections that by nature survive termination (e.g., warranties, liability, governing law) will continue in force.

14. DISCLAIMER OF WARRANTIES (SUBJECT TO ACL)

Except as required by the ACL or expressly stated by us, the Services and all products are provided “as-is” and “as-available”.

15. LIMITATION OF LIABILITY

To the maximum extent permitted by law and subject to Section 7, we are not liable for indirect, incidental or consequential loss. Where liability cannot be excluded, it is limited, at our option, to replacement or repair of the goods or refund of the purchase price.

16. INDEMNITY

You agree to indemnify and hold harmless OFW, Shopify and our respective officers, employees and agents against losses arising from your breach of these Terms or misuse of the Services.

17. GOVERNING LAW

These Terms are governed by the laws of Australia and the State of Western Australia. You submit to the exclusive jurisdiction of the WA courts.

18. CHANGES TO THESE TERMS

We may update these Terms from time to time. Material changes will be posted on the Site and, where required by law, we will notify you by email. Continued use of the Services after the effective date constitutes acceptance of the revised Terms.
